§ 6 Processing of personal data in the context of the applicant and customer acquisition processes by the Mobile Funnel operator and by third parties

(1) General

As part of the applicant and customer acquisition processes, personal data may be forwarded to the following authorized recipients: Relevant internal specialist and HR departments, IT administrators and external service providers, if administratively necessary. Within the applicant and customer acquisition processes, access to your data is granted to those departments that require it within the framework of âLeast Privilegeâ (allocation of user rights to the lowest possible extent) and the âNeed-to-Knowâ principle (knowledge of data only if necessary).

This website uses Mobile Funnel (hereinafter: Funnel), operated by Perspective Software GmbH (hereinafter: Perspective), a company based in Germany, which offers software for the creation and operation of Mobile Funnel (https://perspective.co/impressum). External service providers (e.g. agencies) support us in this process. The data entered in the context of the use of Mobile Funnel are transmitted via SSL encryption and stored in a database. The operator of this website is solely responsible for this data in the sense of Art. 24 DS-GVO. Perspective and external service providers are only operators of the software and in this context processors according to Art. 28 DS-GVO. In addition, Perspective Software GmbH and external service providers process further data in order to provide their services, in particular for the operation of the Mobile Funnel, some of which may also be personal data.

(2) Access logs (âserver logsâ)

With each access to the Funnel, general log data, so-called server logs, are automatically collected. These data are usually pseudonyms and therefore do not allow conclusions about a natural person. Without this data, it would not be technically possible to deliver and display the contents of the software. In addition, the processing of this data is mandatory for security reasons, especially for access, input, transfer and storage control. In addition, the anonymous information may be used for statistical purposes and for optimizing the offer and the technology. In addition, the log files can be subsequently controlled and evaluated in case of suspicion of illegal use of the software. The legal basis for this is found in § 15 para. 1 of the German Telemedia Act (TMG) and Art. 6 (1) f of the German Data Protection Regulation (DS-GVO). Generally, data such as the domain name of the website, the web browser and web browser version, the operating system and the timestamp of access to the software are collected. The IP address of the user is not stored. However, the user is assigned a so-called session ID. The scope of this logging does not exceed the usual scope of any other website on the Internet. The storage period of these access logs is up to 7 days. There is no right to object.

(3) Collection of user behavior data

Generally, data such as the domain name of the website, the web browser and web browser version, the operating system, the user's session ID and the timestamp of the access to the software are collected. All data that the user enters when using the Funnel (e.g. answering form fields; using interactive components) are assigned to the user by means of a session ID and made available to the operator of this website. The operator of this website is responsible for the deletion, storage and further processing of this personal data in accordance with current legislation.

(4) Use of cookies

So-called cookies are used in the funnel. These are small text files that are stored on the device with which you access these funnels. The cookies used serve to ensure the security when visiting a website (âunconditionally requiredâ), certain functions such as

Within the funnels, absolutely necessary functional and performance cookies are used, in particular to implement certain default settings such as the language, to store given answers even with a poor internet connection or to analyze the performance of a funnel and the used channel through which a user has reached this funnel. The use of cookies is mandatory for the provision of our services and thus for the fulfillment of the contract (Art. 6 (1) b) DS-GVO). Storage period: Up to 1 month or until the end of the browser session Right of objection: You can determine yourself via your browser settings whether you want to allow cookies or object to the use of cookies. Please note that disabling cookies may result in limited or completely disabled functionality of the Funnel. The operator of this website has the option to decide individually for each funnel used, which decision options for the use of cookies are given to the user. It is the responsibility of the website operator to use cookies in accordance with the applicable legal restrictions. If the website operator uses extensions from external companies within the funnel, it is the responsibility of the website operator to inform the user about this.

(5) Data subject rights

If personal data is processed by Perspective Software GmbH or external service providers as data controllers, you as the data subject have, depending on the legal basis and purpose of the processing, certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), in particular the right to information (Art. 15 of the GDPR), the right to rectification (Art. 16 of the GDPR), the right to erasure (Art. 17 of the GDPR), the right to restriction of processing (Art. 18 of the GDPR), and the right to privacy.
